I  would like some opinion on ice fishing etiquette.  Do people think it's OK to place jacks out at night and not even bother to fish the next day?  Do these people "own" that spot even though they're not there?

If they leave them baited and in the water unattended I think it is illegal?

You must have full control over lines in the water and if your not there then there is no control. No one owns the water so if I came across something like that check all lines and take the fish. leave a note in the snow saying thank you. i have never seen or heard of anyone doing this is this something you saw?...jim s

Only thing I can think of is that the people intended to come back in the AM, but got waylaid...

I have seen people leave decoys out all night, but not tip-ups...

I think they were trying to get a jump on the derby..but got "waylaid"  no lines in the water just the jacks.  we had been fishing that area pretty hard all week and were disapointed not to fish there.  Do you think it would have been in bad to just fish there anyway?  No people...?

If thats the place I wanted to fis then ya I would have fished it if there was no one around WHY NOT.. NO one ownes the Lake. Maybe the land around it but not the water itself....jim s

You would get a ticket also as it is a trap for fish. Only the warden has the athority to touch them.

You don't know the circumstances.

Went to get bait... Had to take some one home...  emergency...

They plan on coming back obviously. I would just move on, and use it to justify trying a new spot

I think that is pretty stupid leaving your tip ups out over night unattended...even if not fishing.  If i pulled that they would be GONE in the morning with my luck.  If you don't have the drive to get up early enought or stay there overnight then its not worthy of being your spot....

Even if they are fishing Illegally, unless you are a CO.  You are not the law. You are supposed to call the warden, not do their work.

Think about it...  The laws to protect sportsmen from anti's, even if your motives are pure. That is a Trap that has a name and address. It does not belong to you.. That is harassment

So Call the CO if you think someone is breaking the law.

Well, if they aren't set and there hasn't been any activity around them that morning, then fish around them. Were they staked around a shanty? I know this would be a tough call for me if they were around a shanty. I know no one owns the spot that the shanty sits on, but if I happened to just have my shanty in a spot with a few tip ups in front and someone happens to be fishing tipups in front of it while I happen to come out in the evening aftet work to fish, well, I'm sure I wouldn't be pissed, but it depends on how close they were.

This is honestly one thing that I have never really understood about most ice fisherman.  Most of us get really territorial with our areas especially when we do all that work to get the shanty out thre, but I am all about the company, the more the merrier.  I would rather make a fishing buddy out of the whole deal than an enemy.  So i take the attitude that when someone sets up around me or right next to me...who gives a crap...go talk with em' have a few beers and start talking fishing and deer hunting, most of the time ice fishing is all BS luck anyways.

I disagree, if I walk out an set up before daylight for LLS/lake trout for
instance. I am going to be pissed if some guy or group of guys come out
at first light an start cutting 20-30 holes right near (between my tip ups)
 me especially on the inland lakes. If I was on Champlain, I wouldn't think nothing of it.

I found unattended tip ups on Wiloughby last Sunday in the morning darkness.
Being a Sunday an expecting a crowd, I then walked another 1/2 mile 
to find a peace, quite and an area for myself.   

I like setting up early an then waiting for the first light especially on the
inland lakes.

I could see how that would p+$$ you off if someone drilled 20 holes around you right at daylinght after you have been setting up for an hour because in my opinion cutting holes def scares the hell out of the fish.  But if I have been fishin for a while....and the aren't putting them in my tip up...i honestly don't give 2....

No law against leaving tips on the ice as long as they are not baited, I believe the tipups they are refiring to are Champlain type and are left out all the time, on the other hand there is no law that says you can't set up
around them but it could be safer not to.BB

like said before, if you believe somebody is breaking the law, call the warden.   and i also think that if people are gonna fish around me, please ask me before you drill the holes or start fishing the ones that im not using.  just my opinion

Jan,

I see this in many places that I fish.  People put out the Champlain jacks to hold their place on the lake.  I have seen them with no spools or anything, just decoys, to take up space so no one else fishes the area.

I don't like the practice, especially when they are spread all over, but right in front of a shanty is alright.

After one confrontation on Hortonia, I avoid them, because you never know when the owner will show up and "claim HIS spot".  I fish to have fun, not deal with that kind of BS.
