tip up regulations?

I have a question regarding the "two hand line and five tip up" regulation for rods allowed ice fishing.  Do the tip ups have to be purchased flag style tip ups?  I have kind of a homeade version that uses  a 12 inch piece of 1X2 lumber, with screws on either end that I wrap line around. I drill a hole for a bright orange bobber to rest on the 1x2 and the whole thing is painted black.  I set these over the hole, find the depth etc..etc..and rest the bright orange bobber on the hole in the 1x2. When a fish bights the bobber falls off of the 1x2 and I know to go check the line. It seems rudimentary but the work great for me.  It is very easy to tell when you see a hole with no bright orange on the black board. Would these be allowable as tip ups in NY? I don't want to get into trouble my first time out?  Thanks!!

i think you should be fine i could not find anything wrong with homemade tipups. just dont put out more than 5 and you should be fine. they should also have your name on them as well. that i know you must have.

     Sounds to me like, yes. Those rigs would be your tip ups and only five are permitted. Also permo, you have to have your name, address and I believe phone number but I may be wrong on that last one. You have to be able to "attend" them also, so no leaving them out to run up to the store or whatever. Sounds like your a ethical fisherman from all the questions, I respect that a lot, good luck! ;) :tipup:

tip ups tip downs 5 allowed so call them what you want but you shouldnt have a problem

you do need your name and address but its not mandatory to put your # on it. i do if it gets lost or left because theres some nice people out there who will call you up if you loose it.

I heard that the artic warrior - whatever classification it falls in is legal also  , and be able to pick up the pole from the holder and fight the fish with rod and reel . 8)

Excellent! I am glad that I can use these. I would never leave a rod unattended for any period of time. They always needed to be within running distance, so I can yank them perch up! I was however unaware that I needed to have my name and such on them. I guess I need to read the regulations a little closer.  Thanks for the information and all the help so far! My first ice fishing trip in NY is taking place on Sunday and I don't want to get in trouble!

I just moved to Western New York, from North Dakota where I ice fished extensively. This is my first trip of the year and my first trip in New York.

  Well, you know what bothers me most with all the "fishing attorneys" out there. The best way to find out is to either: 1. take the device to your local ECO and have him advise his take on it OR 2. I feel this one is the most logical, take the device to the Regional Office and have them look at it. I spent 34 years in the field and without seeing the device I wouldn't venture a guess.

i apologize for being a "fishing attorney" I just know some devices which are much more questionable as to there designation as tip-ups are allowed so i assumed... :-[

Didn’t you say that the DEC is finally going to put out better descriptions of these devices?

 New Tip-up policy:
 
They have done so, it was completed last year and went to all ECO's and the Regional office. Also, it was posted on I.S. earlier this year. You may procure same by contacting your Regional Office. I was just blowing off steam, here is a guy that's fresh to New York and we have people stating "sounds OK" OR "that's a tip-up" ,when the definitive answer is "contact DEC" , I could not answer the question by a description, also the new policy from Albany mentions " a tip-up flat with a bobber is considered a hand line" so it's going to take more than a description on a post to figure if it will be classified a "tip-up" . I just would hate to have Permo find out by receiving a $50.00 summons !!!!!!

I will try and contact DEC, and describe the device to them. I can't believe how strict things are out here! What is the difference, a line is a line.  The rule in many states is that you are allowed X number of lines out, one per hole. THere is no distinction as to what type or classification the line/rod or whatever falls into.  I do handline the fish in when hooked, but that is also how it works with a flag tip up. Maybe I'll just go buy some more tip ups and end the confusion and not take the risk.

 permo: As you well know, each states regulations are different. Back in the 40's when most of the ice fishing regulations were adopted there was much hook & line commercial fishing. The reason for the regulations was to protect the resources. I could go on for pages and list the reasons for the regulations but as stated, generally it is to protect the resources. Call you local Environmental Conservation Officer, (listed in the fishing guide)meet him or he will come to your home and show him what you have got. Good luck !!!!

he's got the best and safest awmser cause some of our ECO's have there own areas and rules welcome to NEW YORK STATE the place with no money but enough taxes rules &b.s. for the rest of the country!!!

Wow I didn't realize that they would make a house call like that. Very cool.  I have sent an email and will try and call soon enough. I suppose I can find the proper phone number on the dec websight. Thanks for your input  on this, nice getting the advice from a retired officer.

As far as rules and regulations in New York state I will have to say that it is border line rediculous.  I made 5 trips to the DMV in one day to register a car a truck and boat. They didn't think that the picture I provided of the serial number of my boat was good enough, so they were going to have me take a picture of me with a law officer and the boat for some sort of proof. They also were going to make me somehow get the weight of my trailer w/out the boat on it. Find a place to dock the boat, take the empty trailer to a weigh station and get it weighed. Not the most simple of tasks for someone new to the State. I had to have a representative from the trailer manufacture fax a signed document stating the weight of the trailer to the dmv. Turned out it was over 1001 pounds so it had to get it's own title....etc..etc..etc ..etc...they make it so hard to move here and get situated.

 Welcome to NY, land of highest taxes in the nation, highest # of municipality workers per 1000 of populace, highest number of union workers, etc, etc, etc, and enough Socialist laws designed to protect us from ourselves rather than encourraging personal accountability and responsibility.
 Yesterday, our friends in Albany were at it again. Proposing new laws to make it illegal to cross the street in a crosswalk unless you remove / turn off your electronic device such as I-Pod's , cell phones, Blackberry's etc!! Can you believe it?? If you don't have enough sense to "Look Both Way's" as we've heard from age 2, you deserve The Darwin Award!! (Death by your own actions and hence, removal from the gene pool. (Just MHO though)
 Sorry to rant and go off topic Corey. But bring those with you Sunday; I'd like to see them. They don't really sound like what we consider a tip down I and would be cautious until you can get clarification.

The tipups that were used back in the 40's,etc. were thin wooden boards notched to hold your line and one ear was longer than the others. We didn't have rods and reels back then, just handlines. For ice fishing, you inserted a dowel through one of the holes drilled in the handle and wrapped your line around the long end. The tipup was placed and balanced on a couple chunks of ice and a weighted spreader held two snelled hooks baited with minnows. The tipup would bounce up or down when a fish took the bait.
There were no spring flipped flags or spools to wind the lines on. You had to stand close by to monitor your tipups. Oh yes, we caught fish by the burlap sack then, used ice jalopies to get out, windbreaks for shelter and knew where we were on the lake by taking ranges on structures on shore.
You can not take too many perch, unless you can not clean them, give them to your friends and neighbors to clean and cook. The more perch you take, the faster and bigger the rest  will grow. The walleyes and bass will survive from fry to fingerlings.

I heard about that on the radio yesterday morning! I agree with your views on this completely. Hitting into one of those guys that is addicted to his blackberry with your truck while he wanders onto a busy street...talk about a "satisfying crunch" as the snickers commercials would say!  Scott, I am going to be sure and bring with enough standard tipups to cover me so I don't end up on the wrong side of the law. I wouldn't mind snaggin a pike or two, I haven't had any pike to pickle since I moved out here!

     I got to agree with ECO, even though I told you that they sound OK as Tipups. He's right and I should have suggested what he did. Never would I want to get anyone in trouble and I apologize for any assumptions, I did say "sounds like for a reason though. Should have been clearer. Ethics are important and ECO would know the regs better than anyone. Not an @%$ kiss, just don't want to be compared to any half cocked individuals. I always used the wooden cross style. Again, best move is what ECO said!

I have pretty much decided to go pick up 3 more of my favorite tip-ups,the frabill pro thermal, so I have a total of five. This way I won't leave anything to chance, gives me a good excuse to go to gander mountain again too. Wow, do they have a heck of a selection of ice jigs there this season.    ;D
