Champlain/general questions

Hi guys, new to Shanty. I just had some questions. Heading up to Champlain for first time. Can I use treble hooks or double treble for pike? Can I carry a firearm without a permit? Thanks in advance, Bopper.

No you don't.  Anyone in the state of Vermont can carry a gun anywhere they want to.  Except on school property, or a federal building.  You can walk into a store with a loaded gun on your side, and that is your right.

I would check around about the gun being loaded. The state recognizes the lake as a highway while it's frozen and I know while your hunting you are suppose to unload your weapon before crossing a state highway. Some of the Game Wardens up here like to take full advantage of gray areas like that... :-\

Never rely on layman info. about laws or regultaions, on this site or anywhere else. Get the facts straight from the state or other gov't agency with jurisdiction over your particular question, whether gun laws or anything. You will get many well-meaning yet uninformed responses on a site like this, and following advice given here could land you in a heap of trouble.

V.S.A. §4003 Carrying dangerous weapons:
"A person who carries a dangerous or deadly weapon, openly or concealed, with the intent or avowed purpose of injuring a fellow man, or who carries a dangerous or deadly weapon within any state institution or upon the grounds or lands owned or leased for the use of such institution, without the approval of the warden or superintendent of the institution, shall be imprisoned not more than two years or fined not more than $200.00, or both."

Basically - Vermont citizens can carry a firearm (openly or concealed) without getting permission, without paying a fee, without a registration waiting period, & without having to carry a permit.  However, there are hidden loop-holes & town/county laws to worry about.... {Besides school property & government/federal buildings; I believe you cannot go through Burlington, Rutland, Bennington & Springfield with a loaded firearm}  Not sure what your looking to do with a gun on the lake, but hope this info is helpful.

I've always wondered about these local town laws r.e. gun posession, carrying, etc.  When Civil Union legislation passed, Montpelier made an attempt to ban scoped rifles and failed on the basis of an indivdual's right to carry in Vt.  If I remember correctly, the State of Vermont Constitution protects our right to carry and it supercedes the local laws/ordinances.  I DO NOT KNOW this for a fact, just remember the Montpelier thing clearly and how it failed and the basis for that failure.  I s'pose a prosecuting lawyer and private lawyer could wrangle the definitions til hell froze over.  Would be interesting to see it play out again.  Discharge ordinances set in place by the town are supporteed by the state and if violated constitute only a misdemeanor.  I'm off to lookit the state constitution:  Taken from the Sec. of state's website--it's pretty broad but did provide the basis for limiting the City of Montpelier's ban on scoped rifles.

Article 16. [Right to bear arms; standing armies; military power subordinate to civil]

That the people have a right to bear arms for the defence of themselves and the State--and as standing armies in time of peace are dangerous to liberty, they ought not to be kept up; and that the military should be kept under strict subordination to and governed by the civil power.


The employment of effort, hard work, time, and energy put in locating fish will offend noone.
