Anyone ever use a water spitter in NJ?

I know it is a little late in the season and I should have asked this when the temps were below freezing.  Are “water spitters”, a.k.a. coffee can with coiled copper tubing and lit charcoal, legal to use in NJ to keep holes free of ice? I have never seen anyone in NJ using them so I guess the answer is no but I don’t know for sure.  ???
