Do they realize money is involved?? I am pretty sure anytime prizes or money are involved that you have to be a non-profit organization. Just throwing that out there.

It doesn't mean they're doing it legally...

Any time money is paid in with hopes of winning something in return, that is considered gambling. Technically, gambling can only be run with the okay of the state agency overseeing it... NH Lottery. If prizes are given out without a person having to "pay for entry" then it circumvents the "gambling" portion of it.

My stepfather is director of NH Lottery... I do know what I'm speaking about. I have asked him about this in the past due to ideas formed on other websites. You guys do what you want... I won't say anything... I'm just letting ya know, that technically it ain't legal.

well it was done last year for a charity kind of thing and there were prizes and trophys, it was originaly going to be cash prizes to but the turnout wasnt as good as expected, this kids father was in the hospital and he set it up same thing, 5 bucks entry and for trout and it was set up with fish and game with no problems. not sure if they considered it non profit or whatever but that was the whole idea was for him to earn some extra cash for his fathers hospital bills, well see what the outcome is with fish and game as icetrapper is contacting them but all im saying is we had no problem last year

if they dont allow it this time ill be very surpriesed but either way we will do it for fun, all i know is every derby i have gone to has very rarely been put on by a non profit , but we'll see what happens

F&G won't know the legalities behind it. I'm sure they will allow it again. I'm just passing on the true info. Take it for what you will. I just can't read something like this and not pass on the correct info. I like being able to sleep at night and that means telling people when they are about to break the law, which technically this is. Now that I've said it, I wash my hands of it. I simply didn't want to see someone get in trouble (slim chance that it may be) and know that I could have prevented it. That is all... carry on.

why wouldent fish and game know about this law? you have to contact them just to have a derby in the first place? makes no sense to me. all i know is they knew about it last year and said no problem

Tell ya what... I'll send an email to my step dad right now asking him to fill F&G in on the law. We'll leave it in their hands. My guess is that every little bit of money they (F&G) get from people purchasing derby permits is worth more to them than knowing the laws as they pertain to NH Lottery and gambling in general. Actually, I think gambling crimes are State Police's problem. I was just trying to be nice and throw out a word of caution.

whatever , tell them to go bust poker players balls not us derby fisherman, the only reason its against the law is so the state rakes in all the money for gambling, its pretty dumb

if it is against the law to have a derby for cash or prizes than all i can say is there is ALOT of people breaking the law

Hey, why can't we keep it simple everybody brings a $10-$20 item and we pool all the GIFTS together and we can split them up how we want. I have fished several local get togethers and it was whatever you wanted to do.
And after Largest, Longest, Smallest you go to a raffle by numbers in the hat for all that attend and contribute.
to the cause.I think it would be great just to get together and this is just my idea and anyone is welcome to expand on it.

I don't think it's gambling or a game of chance. I think it's a tournament like golf or tennis where skill is involved.
