police checking licenses
« on: Feb 05, 2007, 07:37 PM »
Are police allowed to check your fishing licenses? I dont mind because I always have my license with me everywhere I go. But today I had a police officer come out on the ice to see how I was doing and asked if I had a license. I said yeah and he didnt even want to see it. Just told me to keep it in my pocket, but can they legally check you? just curious

I don't know about any other state, but in Utah they can check you.  They are law enforcement officers, and Conservation Officers are too.  In Utah COs can issue tickets for traffic violations as well.  The only speeding ticket that my wife has ever had was issued by a DWR Conservation Officer.

In Ontario the police cannot ask you to produce your fishing liscense. Only COs can ask you to produce it.  Now the cops could hold you there and call to have the COs come out to check.

well all in all, I think all fishermen should have legal licenses and not have to be hard about showing it to officers. It only takes 30 seconds. Plus they have good info on lakes sometimes. Ive learned a lot from my local CO officer

The police in Ontario can and actually do enforce the Game and Fish Act. I know for a fact Hamilton, Halton, Peel Region and the OPP, all have several officers on their marine units that check licences and lay charges accordingly. They all have damn fine boats for Lake Ontario as well.

They cant here, just ask for your PAL or FAC. Conservation officers ask you for fish and hunting licence. Thats in the Yukon.

In ND, any law enforcement officer can enforce the laws in the century code.  Since fishing and hunting are regulated by that set of laws, any enforcement officer can make an investigation/arrest based on it.  I'm guessing it is the same in most states.

In vt. I know if a landowner (let's say you're hunting their land or accessing water via their land) can ask to see it and I think it's the same as NH--anyone.  Our wardens are as much law enforcement as they are wardens (if that makes sense) so maybe law enforcement can check too here, but I don't know definitely.

The employment of effort, hard work, time, and energy put in locating fish will offend noone.

A cop can check your fishing license and a game warden can give you a speeding ticket. They are both law enforcement officers.

I've fished NY waters just about every weekend for the past 15 years. I've never had a sheriff patrolman ask for my license. They have boarded my boat and checked for all saftey equipment and the proper paperwork for boat registration. The DEC has also boarded my boat for all the above and license checks . They also inspected my livewells and fish. The Conservation officer (CO) in NY has not only the greatest jurisdiction(state Wide) but the legal authority of not only game laws but those of a police officer.
The question was not if you like the idea, but whether they had the authority to do so? It is better to check with state authorities on this question.

Which is one of the loopholes groups like PETA used to exploit.  They would hang out at entrances to state & federal land, and take turns asking you to produce your license.  Depending on the particular state's laws, not showing the license upon demand is a violation.  So they'd keep asking to produce until people would get fed up, then report them for not producing the license.  Cute trick.

gotchya, My dad told me about it when salmon could legally be snagged and then it got to dangerous and they had to quit. Before I figured out how to hook carp in the mouth, everyonce in a while one would get a mepps in the tail ;)

alas, but as a law enforcement agent i am also required to show proof of identifaction apon request..so flip it on them..ask to see there proof of employement/badge...if they are a real law enforcement agent they will show because anything they do after that refusal will be dismissed in court.
