Don't Forget the New Law!!!!!
« on: Mar 15, 2010, 07:07 AM »
Just a little reminder to all who are going to be heading out in the boats soon.
New York State has a new law on the books about wearing a PFD during the cold water months. Just a little reminder to all so the fines dont get you. I think this is for the months of Oct. thru April but not exactly sure on that time frame.

From DEC: New PFD Law: Waterfowl hunters and others should be aware that New York State Law now requires that everyone aboard kayaks, canoes or any other boats under 21 feet in length must wear Coast Guard-approved personal flotation devices (PFDs) from November 1st through May 1st.

New York State has a new law on the books about wearing a PFD in any boat underway, which meens any boat not docked! You must be wearing a PFD at all times even when anchored on any body of water. Just a little reminder to all so the fines dont get you. I think this is for the months of Oct. thru April but not exactly sure on that time frame.

This is just from November 1- May 1 , though, correct? Which means that when I'm out during the summer I won't have to have mine on while fishing?

So what does it take to make a boat "for hire"?  Can I add a 6ft broom-handle to bow of my 16ft boat?  I guess I am asking, how stupidly is this "law" written?

OK,
Here's a good, weird question.  I own an Arctic Armor Plus suit.  If I wear this suit while I am in my 17'  boat perch fishing does that constitute my compliance with wearing a PFD?

No, they aren't considered a PFD.

Are they going to get out the tape measure?  I have a boat that I am in the process of selling that is listed as a four winns liberator 201 but with the swim platform its actually 22".  Seems to me that there are a lot of interesting little issues that could arise with the way this law is written.

Too bad they are not really "looking out for us".  They are trying to create revenue anyway they can.  Our state is really turning into a laughing stock.  Maybe if we could separate NYC into its own state and have 51 states upstate might stand a chance.  Just my opinion.

This might sound silly but I do not doubt they will make ice fisherman wear PFD's in the near future. Just so they can make more money on fines. I do not put anything aside with these state politicians anymore they are all nutz. :o

isn't a boat's length measured from the point of the bow along the gunnels to the stern?
so, a short fat boat and a long skinny boat could both be the same "length", even when side by side one has a longer profile?
seems like my old man told that to me once.
grandpa told me-"never wrestle with a pig. you both get muddy and the pig likes it".

There are a couple ways of measuring boats, for this LOA(length overall) is used; it is the length of the hull. Measure from the point of the bow down the center to the transom, don't include the motor.

The length along the waterline has more to do with stability of the boat.

JJ,
thanks for the clarification. i knew there was something along those lines, couldn't remember what, exactly.

i don't think it's a bad idea to wear a pfd in a boat, and i realize the issues with cold water survival, risking the rescuers, etc. same with a seatbelt or texting while driving a car.
but i don't think enforcement of those laws should be used as a revinue base for the state, or as a means to further investigate people.
