I guess that gives new meaning to the old expression "a bad day of fishing beats a good day at work"  :tipup:  I was seriously thinking about going to Grafton tomorrow but I think I'll wait >:( 

slip i know some guys that are going to shaver tomarrow and they said there was four inches of ice and there should be almost 5 by sunday.

When you go to court take a copy of safe ice limits from the DEC website. If the officer is there ask him how thick the ice was. After his reply show the copy to the judge. Shouldn't be too hard to determine who was in the right......

The problem lies in liability. They are afraid you might get hurt. You are soley responsable for your actions. I believe that this law covers everything and everybody that goes into the outdoors , especially hunters and fishermen.

Back when this came about it was deer hunting on private lands that brought this about. Too many lawsuits made landowners post lands , in turn we had a boom in deer population. In turn there was more people killed or injured by deer than by hunting accidents. So the state enacted this :

If a group of you got together and took it as far as you could I bet you'd be surprised how many would. You would have to be a united front with an attorney willing to push it to the end. Personally I believe the state should put out limited safe ice warnings similar to small craft advisories and that's it. Many more people on the water in boats that shouldn't be and no tickets or people stopping at state launches forbidding anyone to go out. No tickets on the truck trailer combos either. It is still natural selection in this world believe it or not.

A friend of mine ran into the guys that received the tickets, at Bob's Bait this morning. They said the tickets were dropped. You'll probably hear about it in the next few days.........

wow Jim, I would go to court on that ticket, I'm sure it's just local. Ticket will get thrown out but will have to pay court fee (processing) town's way to get extra $$$.

Unless it's changed recently (and I don't think it has) a court can NOT charge you the extra court charge on DEC violations! I know this 1st hand and had it explained to me by the judge who threw out my ticket. And NO, i'm not a slug out there breaking the law...well not DEC law anyways...lol We had been fishing about a mile away from my truck where i mistakenly left my license. He gave me the choice and i took the ticket instead of the walk...lol I was sick of walking for the day. But, the point of this post is...IF you do get a ticket, DON'T let them charge you the court surcharge too!

p.s.  that being said, its a shame that this country has become so over-regulated that we now have laws to protect people from themselves.  Would have been nice if the officers gave some sort of friendly warning the first time and asked folks to leave.

I'm a law biding citizen, I pay my taxes and I'm proud to raise my family in such a great country.  Yes these rabbits were shot recently and legally.  The fact of that matter is buddy, have to looked out the window lately?  My country is over run with rabbits.  In turn in a couple of years after suffering  a long slow agonizing death from a horrid disease they will have faced the same fate.  At least my family has been feed.  Now go eat some lettuce and hump a tree.

It wasn't the cops fault for the tickets its the people at the park. They just have the officers enforce the law. Thats why you should fight it. The officer will probably back you with the ice being safe. He is told to enforce something that a person who probably didn't even step out on the ice to check it out. I had the same problem at Thompson lake and was told by the ENCON office that the park issues statements that the ice is unsafe and that they can only advise that the ice is unsafe. Unless the laws have changed from 3yrs ago Somebody from the park told the officer to hand out tickets, unless the park is closed there should be no tresspass complaint. I bet if you fight it officer wont even show because he knows it's a bull**** complaint.

 When you guys go to court, here is some info that me be helpful in the event that you try to fight it. These are the guidelines as for the load bearing capabilities for ice as determined by the United States Corp of Engineers:
 (you could get it from the web and print it with their heading)


Required Minimum Ice
Thickness in inches / Description of
Safe Moving Load:

1-3/4 inches: One person on skies
2 inches: One person on foot or skates
3 inches: One snowmobile
3 inches: A group of people walking single file
7 inches: A single passenger automobile
8 inches: A 2-1/2 ton truck
9 inches: A 3-1/2 ton truck
10 inches: A 7 to 8 ton truck

Sorry to her your misfortune!!!  My in-laws live just a short distance from there and I was thinking of going Sunday but after reading your post I bagged it!  It's to bad that such a great fish has been over shadowed by the dark cloud of the law.  Good luck in court!

AMEN to that dude!!! I will back that statement 100%.Many don't want to be accountable for their actions, or more importantly, hold others accountable for their actions. The problem is not usually the icefisherman that screws up and falls through the ice though, or his family. It's some rich pigs wife sitting at home with nothing better to do that reads about that and makes it her crusade to end such a "needless tragedy". As for the picture, I personally am not a big "killer" in general. I have and I'm sure I will in the future, but it's not my most favorite thing. However, I will defend tooth and nail everyones rights to kill, take or otherwise harvest anything that they want to within the limits of the law. AND....i think the PETA thing was hilarious!

This was NOT a DEC officer or a DEC violation. It was a Park Police officer and a Parks and Rec law violation.

Well I went back for a few hour. No tickets or trouble this time ;D Just a few hours and landed this 19 inch female. When i got her home I found that out the hard way. She had a belly full of eggs. I actually felt kinda a bad.  :-\ I had a fews near misses with the forage minnow and my ice fly.  The bite was lite and it was almost like they were lipping it. I also had a few tip ups go up with a little bit a line let out and then it dropped the bait. Wonder why they do that :cookoo:

jflood they don't spawn anyway so don't worry about it!  It's strictly a put and take fishery for the stocker trout in the lakes and ponds around here.  Some of the stream fish do reproduce but rainbows can't reproduce in a lake or pond like Moreau, Trout or the lakes at Grafton.  That's a nice bow by the way 8)
 

Is there a biological reason why they dint spawn? Would all of those eggs gone unfertilized ???
I know its a put and take lake but does that mean they don't have the ability to reproduce ???
Not trying to be a smarty pants  :-\I have a genuine interest in all these questions :)

They need flowing water to spawn, ie a tributary.  Lake George did have a remnant population of breeding rainbows(very small numbers), not sure if there are any left though.

Went to court today and the charges were dropped. :) Before I went to court I figure I stop by Moreau and give the trout a try. 4 flags & one fish 8)
