Baitfish or other legally taken fish species intended to be used as bait taken may only be used in the same water body from which they were caught for bait in hook-and-line fishing. Transportation of personally harvested baitfish overland by a motorized vehicle is prohibited (see exceptions for smelt, suckers, alewives and blueback herring taken for human consumption).
To simplify the law that JJ posted: Use them where you catch them, and don't transport them in you truck.

Caught my biggest largemouth as a kid on a sunfish. Any legally caught fish(except Carp, goldfish, lamprey larvae and round goby) can be used as bait in NY, they must count towards your daily limit and they can't be transported over land.From here: http://www.dec.ny.gov/outdoor/47282.html

cool thanks. How about sunfish.I know they were not legal to use for bait in florida.But it's a whole different game up here though.I tried to search the dec website and didn't find anything.
well i know what i am doing with those 2 inch dinks i catch at sandy pond.Guess i will take more than 3 tipups sunday.I usually dont fish tipups there.just too much to deal with when using fatheads.The dinks are poping flags and i am chasing them and my son is in the shanty filling a bucket with keepers.Go figure huh.LOL.
