"Smitty Sled" To Be Trademarked

I have submitted an application to the USPTO (United States Patent & Trademark Office) for the name "Smitty Sled", I am keeping my fingers crossed it gets the approval, may take up to 18mo. they say, hopefully sooner. Keep up on the great support here., I really appreciate it. Tight Lines Guys.

Smitty-- you certainly worked on your designs for a long time and have promoted them well in solving a chronic problem that ice fishermen face. Just bear in mind that similar designs were on the ice at least 40 years ago by my memory and I've been making them for almost that long myself. However, there's at least one good reason that they're called "Smitty Sleds" and not "Stinky Sleds". You've done a good job with your designs and should certainly capitalize on the brand name.

For some reason, the board ate my response, but here we go again. Congrats and good luck on the application, and here is my artsy-fartsy version. I am no woodworker or I would make mine this way, but a guy with a router and dremel might have a go. I plan to make a painted version for myself all done up as a brook trout or maybe a pike considering the length. Basic design with (4) 2x10 blocks. Feel free to steal my design.

Just make sure that Ron Popeil (RONCO), the guy that does the OXY-clean crap now, or the guy selling MYPILLOWS don't try and "claim-jump" you!

If the name "Smitty Sled" is trademarked, you couldn't build and sell them under that name.  You could build the exact same thing for sale and call it a "Dukhnter sled" and be fine.


If the design of the sled is patented, and he gets the name trademarked, you couldn't sell an identical design under any name without permission.


Either way, there's nothing preventing you from reverse-engineering any design and building it for yourself.  The only issues really come up with selling, and advertising for sale.

Thanks, just messing around with him a little. Wondered if the home built ones would have to have an approved by smitty statement on them if it goes through. Only thing I would do is rebuild mine or help a friend build one.

You certainly would reap profits if you offer a adjustable kit w/ hardware-- possibly aluminum frame w/ Hyfax runners-- Take my money plz!
